FCC Denies Fine Extension

WASHINGTON, DC--Feb 2, 1999--The FCC has denied a request by a Florida ham for an extension to respond to a forfeiture order resulting from an alleged nonamateur violation of FCC rules. Jeffrey G. Guss, KF4MWT, of Palm Bay, Florida, was fined $2500 last October for alleged intentional interference to a Business Radio frequency. On November 6, Guss requested an unspecified time extension claiming he had not had adequate time to confer with his attorney and needed to look into his options further.

In a letter January 26, the FCC's Riley Hollingsworth pointed out that the Commission's initial Notice of Apparent Liability was issued in February 1998, and that Guss had filed a response last June. "You have had more than adequate time to consult with your attorney and make a decision regarding your options in this case," Hollingsworth said.

Hollingsworth said that if the $2500 fine is not paid, the matter will be referred to the US Attorney's office for collection. The FCC has not indicated whether Guss's alleged Business Band violation will affect his Amateur Radio license or future Amateur Service applications.
