Ham HT On Public Safety Bands

One of the local emergency management offices just posted to Facebook how they were communicating between hams and public safety personnel on UHF with a Wouxun KG-UV6X.

I didn't think it was legal for a radio to both communicate on public safety bands and amateur radio bands. Did I misinterpret those rules?

A radio that is used in the public safety bands requires Part 90 certification. Ham radios that are not Part 90 compliant cannot be used in the public safety bands. Part 90 radios can be used in the Ham bands.
