FCC Enforcement Letters

FEDERAL COMMUNICATIONS COMMISSION
Enforcement Bureau
Spectrum Enforcement Division
1270 Fairfield Road
Gettysburg, Pennsylvania 17325-7245

CERTIFIED MAIL-RETURN RECEIPT REQUESTED

January 26, 2007

Grady E. Kidwell, President
Fannin County Electric Cooperative, Inc.
P. O. Box 250
Bonham, TX 75418-0250

Dear Mr. Kidwell:

The Federal Communications Commission notified you by letter dated February 22, 2006 that it had received complaints of harmful radio interference possibly caused by power line equipment maintained by your company. The interference was reported by (name withheld) Windom, TX 75492. A copy of that letter is enclosed for your convenience.

In that letter you were advised that this problem, if unresolved, could be a violation of FCC rules and could result in a monetary forfeiture. For this reason, we encouraged the parties involved to voluntarily resolve this matter without FCC intervention. The February 22, 2006 letter stated, however, that if it became necessary for the FCC to facilitate a resolution, the FCC might investigate possible rules violations and address appropriate remedies, including monetary forfeiture. Fannin County Electric Cooperative has not responded to the February 22, 2006 letter. (name withheld) reports that although a slight effort was made by Fannin personnel to make repairs on November 21, 2006, the radio interference problem has not been corrected.

In order to avoid enforcement action in this matter, you are requested to respond to this office within 30 days of the date of this letter describing what action Fannin intends to take to correct (name withheld) radio frequency interference.

If you have any questions about this matter, please contact me at 717-338-2502.

Sincerely,

W. Riley Hollingsworth
Special Counsel

Enclosure
