RE: Warning Notice--Radio
Frequency Interference

Dear Mr. & Mrs. (deleted):
On May 12, 2003, the Commission's Consumer & Governmental Affairs Bureau notified you that it had received complaints that an electric fence charger at your residence was causing harmful radio interference to an operator in the Amateur Radio Service. The complainant is:

The May 12, 2003, letter notified you that the FCC has the responsibility to require that such problems be rectified within a reasonable time if the interference is caused by faulty consumer equipment, and that Consumers Energy Company, your power provider, had verified that the charger is a source of radio interference.
The May 12, 2003, letter further notified you that this problem, if unresolved, could be a violation of FCC rules and could result in a monetary forfeiture for each occurrence. The letter encouraged the parties involved to voluntarily resolve this matter without FCC intervention. The letter stated that if it became necessary for the Commission to facilitate a resolution, the Commission might investigate possible rules violations and address appropriate remedies, including monetary forfeiture.
You were further advised to inform the complainant by July 12, 2003, of what steps you were taking to correct this reported interference problem, and to advise the Commission by the same date. The May 12, 2003, letter was sent regular mail and certified mail, but the certified letter was returned to us "unclaimed," and we have enclosed a copy for your convenience. According to Mr. (deleted) the harmful interference remains unresolved. Furthermore, you have responded to neither Mr. (deleted) nor the Commission within the specified period of time.
In order to avoid possible enforcement action, it now is imperative that you advise this office by July 15, 2004, of what action you have taken, or intend to take, to correct the radio interference.
