RE: Warning Notice: Radio Frequency Interference

Dear Mr. (name withheld):

The Federal Communications Commission notified you by letter dated August 21, 2006 that it has received complaints of harmful radio interference caused by equipment associated with a swimming pool solar heater at your residence.

In the August 21, 2006 letter, you were advised that this problem, if unresolved, could be a violation of FCC rules resulting in a monetary forfeiture for each occurrence. For this reason, we encouraged the parties to voluntarily resolve this matter without FCC intervention. We notified you, however, that if it became necessary to facilitate a resolution, the FCC might investigate possible rules violations and address appropriate remedies, including monetary forfeiture.

You were further advised to inform the complainant within 30 days of what steps you were taking to correct this reported interference problem. According to the complainant, the harmful interference he reported to this office remains unresolved. Furthermore, you have responded to neither the complainant nor this office within the required time.

In order to avoid possible enforcement action, please advise this office by November 15, 2006 of what action you have taken, or intend to take, in order to identify and correct the source of the radio interference.

If you have any questions about this matter, please contact me at 717-338-2502.

Sincerely,

W. Riley Hollingsworth
Special Counsel
